TERMS AND CONDITIONS OF THE KAZAR AND KAZAR STUDIO GALLERY

These Terms and Conditions govern the access, browsing, and use of this Gallery, taking into account Polish regulations regarding copyright, image protection, and consumer rights.

Through the brands KAZAR and KAZAR STUDIO, Kazar Group sp. z o.o., with tax identification number PL7951532361, offers users the opportunity to upload photos, comments, videos, and other content via designated sections in social media to interact with the online sales platform for Kazar and Kazar Studio products: www.kazar.com, www.kazarstudio.com, www.eu.kazar.com, www.de.kazar.com, www.fr.kazar.com, www.nl.kazar.com, www.it.kazar.com, www.es.kazar.com, www.cs.kazar.com, www.hu.kazar.com, www.ua.kazar.com, www.en.kazarstudio.com.

You must read and accept these Terms and Conditions before using the Services. If you do not agree with these Terms and Conditions, you should not use the Services. The use of the Services does not establish any contractual relationship between the user and the Kazar or Kazar Studio brand.

1. Publishing Photos in the Gallery
   

   All photos published on social media tagging @kazar or @kazarstudio, and/or using hashtags such as #kazarstudio, #kazar, may be selected by Kazar for display on the website www.kazar.com, www.kazarstudio.com, www.eu.kazar.com, www.de.kazar.com, www.fr.kazar.com, www.nl.kazar.com, www.it.kazar.com, www.es.kazar.com, www.cs.kazar.com, www.hu.kazar.com, www.ua.kazar.com, www.en.kazarstudio.com. To be eligible, user profiles must be public. Photos from private profiles will not be visible and, therefore, will not be considered.

2. Photo Selection Criteria and Visual Identity Guidelines

   Kazar will select photos that highlight the brand's products and best align with the brand's image and spirit, in compliance with fair competition rules and consumer protection regulations.

   • Photos must clearly display at least one product from the Kazar or Kazar Studio brand.
   • Photos will be selected based on their size, quality, and aesthetics.
   • Under no circumstances may photos violate public order, good morals, or applicable laws.

   The publication of photos that:

   • infringe on the copyrights or image rights of others,
   • contain offensive, violent, dangerous, threatening, defamatory, hateful, discriminatory, blasphemous, or pornographic content,
   • violate Polish law, including consumer protection and data protection laws, is strictly prohibited.

   Kazar is not obligated to use photos even if they meet all the conditions of this Regulation. If a photo is selected, the user will receive a message on social media from Kazar’s official account. The user must provide consent by responding with the hashtag #yesKazar or #yesKazarStudio which will signify acceptance of these Terms and Conditions.

   
   

3. Transfer of Economic Copyright to the Photo

   The participant declares that they are the sole owner of the economic copyrights to the submitted photo and have obtained consent from individuals depicted in the photo to use their image.

   • For photos featuring minors, the participant declares that they have obtained prior consent from their legal guardians.
   • By submitting the photo, the participant grants Kazar Group sp. z o.o. a non-exclusive, free-of-charge, transferable license, limited to a duration of 5 years and with no territorial restrictions, for promotional purposes.

   Kazar is entitled to:

   • publish the photo on www.eu.kazar.com, www.en.kazarstudio.com.
   • modify the photo as necessary to fit the website’s format,
   • present the photo on social media, with clear attribution to the author.

   All moral rights related to photo authorship remain intact. Kazar commits to using photos in compliance with Polish regulations on image protection and with respect for the author's dignity and reputation.
   
   

4. Request for Photo Removal
   

   The user may withdraw their consent for the use of the photo or request the deletion of their personal data in accordance with the GDPR at any time. To withdraw consent for photo usage, please send an email to bok@kazar.com, and to request deletion of personal data, contact Kazar's Data Protection Officer at iod@kazar.com. Kazar will cease using the photo in compliance with applicable legal regulations.
   
   

5. Personal Data Processing
   

   The data controller is Kazar Group sp. z o.o. (NIP: PL7951532361).

   • Purpose of data processing: Publication of photos on the website and their use for promotional purposes of Kazar and Kazar Studio.
   • Legal basis: User consent (Article 6(1)(a) GDPR).
   • Data retention period: Data will be stored for the duration necessary for promotional purposes, but no longer than 5 years from the date of submission.

   The user has the right to:

   • access their data,
   • rectify their data,
   • erase their data,
   • restrict data processing,
   • transfer their data,
   • object to data processing.

   All requests should be directed to iod@kazar.com. Data will not be shared with third parties unless required by law.
